PRIVACY POLICY

Pluckers Club® is a rewards program offered by Pluckers Wing Bar for Pluckers Customers. For purposes of these rules and regulations (hereinafter "program rules" or "rules") of Membership, the terms "Pluckers®," "we," "us," and "our" refer to Pluckers Wing Bar., and the term "the program" refers to the Pluckers Club program. The terms "transition date," "launch date," "transition," and "program launch" refer to April 24, 2018 the date that Pluckers Wing Bar launched the revised Pluckers Club program. The terms "Member," "Members," "you," and "your" apply to you as a Member of Pluckers Club; the term "account" refers to your Pluckers Club Membership account; and the term "points" refers to your Pluckers Club Points earned after the transition date. The term “calendar year” means January 1-December 31 of each year.

Pluckers reserves the right to amend, suspend, or change the program and/or program rules at any time without notice. Club Members do not acquire property rights in accrued points and awards. By enrolling and/or participating in Pluckers Club, you agree to abide by these rules and regulations.

Pluckers is not responsible for unauthorized access to a Member’s Account and will not replace stolen points or awards.

By enrolling in Pluckers Club, you confirm and represent that you are the Member or that, if the Member is a minor, you are the child’s parent or legal guardian. If you are the child’s parent or legal guardian, you also confirm and represent that you, and not the child, are providing the child’s information to Pluckers.

Pluckers Club program members (“Members”) agree that their personal information provided and/or generated as result of their participation in the Program may be used by Pluckers for marketing, promotional and/or service purposes.

This privacy policy sets out how we deal with personal and transactional information collected through the Pluckers Club Program (“The Program”), the Pluckers Club Website (“The Website”) and the Pluckers Club Mobile App (“The Mobile App”).

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to participate in the Program, use this Website and the Mobile App. By accessing or using this Website and/or the Mobile App, you agree to this privacy policy. Our Program, Website and Mobile App are not intended for children under 13 years of age. No one under age 13 may provide any information to or post any information on the Website and/or the Mobile App. We do not knowingly collect personal information from children under 13. If you are under 13, do not (i) register on the Program, (ii) use or provide any information on this Website or the Mobile App, (iii) use any of the interactive or public comment featured on the Program, this Website or the Mobile App, or (iv) provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. By participating in the program, you consent to the use and processing of your personal and transactional information in accordance with this privacy policy. We use the information we collect about you to help us understand more about how you use the Program, and to communicate with you, either electronically or otherwise, in order to provide you with rewards and specials that may be of your interest. The 'personally-identifiable information' we collect is information that enables us to identify you, such as your email address, name, phone number, birthday, and zip code. In addition, we also collect ‘transactional information’, by tracking your purchases at Pluckers, your responses to email communications sent by Pluckers, your usage of the Mobile App and your geo-location, as provided by the Mobile App. By participating in the program, you expressly authorize Pluckers to collect, manage and safeguard your personally identifiable and transactional information. By participating in the program you acknowledge that no data transmission over the Internet can be entirely secure. Therefore Pluckers does not guarantee the security of your personal and transactional information. However, we use reasonable measures to protect the security of your personal and transactional information from unauthorized access or use by using encryption technology and other industry-standard data protection practices. Any transmission of personal information is at your own risk. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Mobile App and/or the Website, you are responsible for keeping such password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Mobile App and the Website. The information you share in public areas of the Mobile App and/or the Website may be viewed by others. We are not responsible for circumvention of any privacy settings or security measures contained on the Website and/or the Mobile App.

In order to apprise our Members of their membership status as well as new benefits that are available to Program Members, Pluckers may from time to time send members certain program information, including printed, e-mail and push notification messages, which will inform them of special offers and products Pluckers believe would be of their interest. By enrolling in the Program, Members consent to receive the type of information described above. Members may opt out of email communications at any time, by simply clicking on the “Unsubscribe” link included in all email communications. Members may also opt out of push notification communications directly from the Mobile App (“My Account” section, “Notification Settings” sub-section).

Pluckers does not rent, sell, or share personal and/or transactional information about Program Members with other people or non-affiliated companies except to provide products or services members have requested, when we have their permission, or under the following circumstances:

  • We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
  • We believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the Program’s Terms and Conditions, or as otherwise required by law.
  • We transfer information about Members if Pluckers is acquired by or merged with another company.
  • We limit access to personal information about Members to employees who we believe reasonably need to come into contact with that information to provide products or services to Members or in order to do their jobs. Pluckers agrees that it shall take all reasonable measures to protect the secrecy of and avoid disclosure and/or unauthorized use of personal information provided by Members and/or generated as result of their participation in the program

You may send us an e-mail at ____@_____.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any transactions involving personal information will be encrypted using SSL technology.

The date the privacy policy was last revised is identified at the bottom of this page. You are responsible for ensuring we have an up-to-date active and deliverable e-mail address for you, and for periodically visiting our Website and this privacy policy to check for any changes.
